The annual allowable increase

Under Oakland's Rent Adjustment Program, the annual CPI rent increase effective August 1, 2026 is 2.3 percent. The rate applies from August 1 through July 31 of the following year, and the prior year's rate, effective August 1, 2025, was 0.8 percent. Since a June 2022 change, the increase is 60 percent of the CPI change or 3 percent, whichever is lower.

Banking and notice rules

  • Owners may defer allowed CPI increases for up to five years, and unused increases then expire. The five-year limit applies starting January 1, 2026 and does not cover notices served on or before December 31, 2025.
  • A single annual increase cannot exceed three times the current CPI.
  • Owners must give at least 30 days' written notice, and every increase notice for covered units must include a copy of the RAP Notice.
  • Owners cannot raise rent on a unit that is not registered with the Rent Adjustment Program.
  • No increase can take effect until six months after the tenant first receives the RAP Notice.
  • Only one increase is allowed in any 12-month period, and the first cannot take effect until 12 months after move-in.
  • If the lease has a fixed term, an increase generally waits until the lease expires unless the lease allows it sooner.

If you get a rent increase notice

  1. Check that the notice includes the RAP Notice and states the percentage.
  2. Compare the percentage with 2.3 percent, the CPI rate for August 1, 2026 through July 31, 2027, and ask whether the owner is using banked increases.
  3. Check whether the unit is registered with the Rent Adjustment Program.
  4. Ask your landlord in writing to explain any increase above the annual rate.
  5. Contact the Rent Adjustment Program through the City of Oakland to ask about a petition.

Who is covered

The City's page refers to units covered under the Rent Adjustment Ordinance but does not list them. It does say that if all current tenants are new, the owner can set a market rate, while units with original occupants from a prior tenancy remain subject to the ordinance. Check the City's program page to confirm whether your unit is covered.
