Deadlines to file a lawsuit in West Virginia

The deadline to file a personal injury lawsuit in West Virginia is generally 2 years, which is the same as the most common period of 2 years across the country (W. Va. Code § 55-2-12). For a written contract the period is 10 years and for an oral contract 5 years.

Worth knowing: Minor tolling applies; discovery rule recognized.

Deadlines can start later or pause in some situations, and claims against government bodies often have much shorter notice periods. See what a statute of limitations is and what to do after a car accident.

Security deposits in West Virginia

Landlords in West Virginia must return a tenant's security deposit within about 60 days (60 days, or 45 days after a new tenant moves in, whichever is sooner; § 37-6A-1). Missing the deadline can cost a landlord the right to keep deductions, and some states add penalties.
